On the fourth day of deliberations, the jury was deadlocked on the charges and are set to return for a fifth day of deliberation on June 16, Friday.
"Do you agree that there is a hopeless deadlock that can not be resolved by further deliberations?" the judge asked each juror, who responded "yes".
Constand was one of dozens of women who accused Cosby of drugging, and or initiating sexual contact without consent, and her case narrowly beat the 12-year statute of limitations.
The Montgomery County District Attorney's office said it will immediately retry the case. Constand said she took them with trepidation because she trusted him as the mentor and friend he was. He also dismissed the district attorney's pledge to retry the case. Cosby team gave brief statements to the press, and all of them seemed to be satisfied with the result of the trial.
A spokeswoman then read a prepared statement from Cosby's wife Camille, who has steadfastly stood by her husband over the years, even after the accusations against him piled up.
Only one other accuser, Kelly Johnson, was allowed to testify as prosecutors sought to establish that Cosby had demonstrated a pattern of assault.
"Bill Cosby has already been exposed as a predator who hid behind his jovial mask for more than 50 years and no jury verdict will ever change that", she posted on Facebook.
If found guilty, Cosby could go to prison for the rest of his life. She had alleged that in 2004 that Cosby gave her pills, knocking her out until she woke up and felt Cosby groping her breasts and " his hand inside my vagina, moving in and out".
The next person to speak was McMonagle, a criminal attorney who Cosby's publicist compared to celebrated criminal attorney Johnnie Cochran, who is best known for leading O.J. Simpson's successful defense. The deposition's in Constand's civil suit were released and the Montgomery County D.A.'s office chose to reopen the case and arrested Cosby.
The mistrial leaves in limbo a large slice of American popular culture from Cosby's six-decade career as a comedian and actor.
